Terms of Service

1. Acceptance of Terms

By accessing or using SaaS Pawned? (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and anyone who accesses or uses the Service.

2. Description of Service

SaaS Pawned? is a free web-based tool that scans npm and pnpm dependency files against public vulnerability databases and generates AI-powered security assessments. The Service is provided for informational purposes only and does not constitute professional security advice.

3. Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree to use the Service exclusively to scan dependency files that:

  • Belong to you, your organization, or a project you are authorized to audit.
  • You have lawful access to and a legitimate security interest in analyzing.

4. Prohibited Conduct

You may not use the Service to:

  • Scan dependency files belonging to third parties without their explicit authorization.
  • Send automated, scripted, or bulk requests beyond normal human usage patterns, including scraping, crawling, or bot-driven submissions.
  • Circumvent, bypass, or attempt to defeat any rate limits, access controls, or security measures.
  • Attempt to probe, test, or exploit vulnerabilities in the Service itself or its underlying infrastructure.
  • Use the Service in any way that could damage, disable, overburden, or impair its availability or performance for other users.
  • Reverse engineer, decompile, or attempt to extract the source code or proprietary logic of the Service.
  • Use the Service for any unlawful purpose or in violation of any applicable local, national, or international law or regulation.
  • Misrepresent your identity, affiliation, or the ownership of the files you submit.

5. Rate Limits

The Service enforces automatic rate limits (currently one analysis per minute per IP address) to ensure fair access. Attempting to circumvent rate limits — including through the use of proxies, VPNs, or rotating IP addresses for the purpose of evading limits — is a violation of these Terms and may result in permanent suspension of access.

6. Data You Submit

By submitting a dependency file and associated project information, you represent and warrant that:

  • You have the right to share that information with us and our third-party processors.
  • The submission does not violate any confidentiality obligation, trade secret, or third-party rights.

You grant us a non-exclusive, worldwide, royalty-free license to use, store, process, and share submitted data as described in our Privacy Policy.

7. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that: (a) the Service will be uninterrupted, error-free, or secure; (b) vulnerability scan results are complete, accurate, or up to date; (c) AI-generated assessments are free from errors or omissions. Scan results should not be relied upon as a substitute for a professional security audit.

8. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Service — even if we have been advised of the possibility of such damages. Our total aggregate liability for any claims relating to the Service shall not exceed CAD $50.

9. Indemnification

You agree to indemnify, defend, and hold harmless SaaS Pawned? and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Suspension and Termination

We reserve the right to suspend or permanently block access to the Service for any user who violates these Terms, abuses the Service, or engages in conduct we determine to be harmful — at our sole discretion and without prior notice or liability.

11. Third-Party Services

The Service integrates with third-party providers including OpenAI, Google Firebase, Google Analytics, and OSV.dev. Your use of the Service is also subject to the terms and policies of these providers. We are not responsible for the practices or content of any third-party services.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Quebec, Canada.

13. Changes to These Terms

We may revise these Terms at any time by updating this page. The effective date at the top reflects the most recent revision. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
